with us saga adjacent like this as many of you know earlier this year the Gossip Ghoul alum starred in her sequel Another Simple Extortion co-starring Anna Kendrick for a while now there had been rumors that the two of them don’t get along rumors that were seemingly confirmed by Kendrick herself remember at the movies premiere at the South by Southwest Film Festival Anna was asked what it was like to be working again with Plague Lively and she said “Oh you know that was it.” That was her response the Pitch Perfect alum then refused to take any pictures side by side with her on the red carpet or even inside of the theater well now months later their co-star Henry Golding has taken this which went away and brought the heat back up again thank you the super dreamy actor whom many people also know for his role in Crazy Rich Asians was just on Watch What Happens Live playing a game it’s called One to Agree or Disagree andy Cohen asked if there’s usually at least a little bit of truth behind rumors that two co-stars are clashing on set and Henry Golding held up a sign that said “Agree if there are rumors that co-stars are clashing on set there’s some truth to it,” he said up andy Cohen the host of Watch What Happens Live sure made a point of singling out quote says one of the stars of a simple favor henry responded “I don’t know what you’re talking about.” “Oh yes you do i always believed those rumors how about you?” Additionally this just popped up on my feed ryan Reynolds says he and Blake Lively are born people pleasers i didn’t even bother reading it next as many of you might know the Garden Variety actress served a subpoena to Justin Baldon’s lawyer and law firm brian Freriedman who is also my lawyer as well as representing Baldoni and the Wayfairer parties who’s not given me any information or swayed my opinion or offered to give me a discount for all the times I’ve mentioned him he filed a motion to quash that subpoena and now has filed a supplemental memorandum to its motion to quash subpoena let’s go through this and see if there’s anything interesting to share this was just filed in court in California because the Never With Teeth icon is trying to get this moved to the Southern District of New York where Judge Lyman is overseeing the federal case lively claims that she’s entitled to discovery from Justin Baldon’s law firm even though to me not a lawyer I would instantly think um attorney client privilege why are you wasting the court’s time you’re not entitled to that let’s see what they have to say the law firm is called Liner Freriedman Tatleman and Culie so from now on it’ll be referred to as LFTC Belon’s law firm respondent Blake Lively contends she’s entitled to discovery from LFTC because it acted as the agent of its clients in coordinating adverse statements about her to media outlets first all litigation councils are agents for their clients yeah duh simply because a lawyer advocates for his client even if reported by the press does not entitle opposing parties to discovery of that lawyer’s files yes to hold otherwise would eviscerate as I mentioned to you would eviscerate the attorney client privilege and work product doctrine simply by equating advocacy with a retaliation claim second well actually shout out to this image that it’s an illustration that I had one of my uh chat friends make for me i kind of love it second Lively’s theories of hypothetical relevance do not rise to the level of crucial required to obtain discovery from opposing council once again fact nothing but facts thus far and you all know I keep it real just yesterday I was saying “Oh you know team Diddy is making a lot of valid points here or there and I don’t want Diddy to win i don’t like Team Diddy i call it as I see it i’m team truth.” Lots of facts so far this latest supplemental document is in response to Blackface Barbie’s motion to compel literally I truly think I am halfway to Kim Kardashian i’m in a good mood today i’m at least halfway to Kim Kardashian legal scholar thanks to this trial my mom always wanted me to be a lawyer i would have been so good i have zero desire to do that but in an alternate universe I am litigator extraordinaire team Baldoni references law that states in order to get discovery from opposing council you must show no other means exist to obtain the information she can get the information many other ways the information sought relevant and non-privileged and three the information is crucial to the preparation of the case i think she loses on at least two of those three third Lively fails to address authority directly on point instead relying on factually distinguishable cases multiple California district courts have directly addressed the issue of document subpoena directed to opposing council that sought documents relating to statements to the press after a dispute has arisen they mentioned that each case cited by Lively involved a lawyer who was either an integral part of their client’s business process outside of their role as lawyer or specifically injected themselves as a witness during the litigation in those instances discovery is appropriate lively does not contend that LFTC is a part of Wayfairer’s business operations or that it affirmatively injected itself into the litigation as an expert or through factual declarations rather she contends that she’s entitled to obtain documents from LFTC because it was a witness and an agent for its clients in an alleged smear campaign surely Lively does not contend that statements to the press entitle her to broad access to LFTC’s files indeed her own council has made numerous public statements regarding the litigation surely Lively did not intend to invite a subpoena to her own council oh this is biting i love it lively subpoena should be seen for what it is a fishing expedition meant to harass her opposing council based on a hypothetical theory of relevance additionally LFTC does not consent to transfer of this motion to the Southern District of New York they argue in a footnote while LFTC’s website identifies a New York address as an office location no LFTC attorneys or staff regularly work out of that office they cite law saying that the prime concern in transfers should be avoiding burden on local nonparties and they say the interests weighing in favor of transfers so clearly outweigh the interests of LFTC in having a local court determine its rights additionally whether LFTC has the ability to litigate in New York which they do does not deprive it of its right to have this court in California decide whether a subpoena directed to it should be quashed quash it they say i think they should i think most people would even without law degrees what
