Things have been so quiet lately with the executive of extortion and Justin Baldoni. But thankfully, two big developments just happened and I’m going to tell you all about it. Hello my frame. Our first update number two to come has to do with that infamous video that Justin Baldon’s producing partner Jamie Heath showed the wife of Scarlett Johansson’s ex-husband on the set of It Ends With Us. the birthing video, the real life birthing video of Jaime Heath’s wife giving birth at home in the little pool and she was taken aback and things have just spiraled out of control because of that video. And once again, ethically challenged Ezra is demanding sanctions. I’ve really missed this so much. In a letter filed to her bestie, Ezra says, “Dear Judge Lyman, Miss Lively respectfully moves the court to sanction defendant Jamie Heath pursuant to rule 37 of the Federal Rules of Civil Procedure for failure to comply with the court’s August 27th, 2025 order compelling the production of certain materials. The video Mr. Heath showed Miss Lively on the set of the film of his fully nude wife during the birth of their child during an at-home birth (arenthesis) birth video without warning or consent by September 2nd, 2025.” Spoiler alert. According to team Ricula, Jamie Heath and the Baldoni wayfairer parties did not produce what was required. Or so they want the judge to believe. As always, I’m looking forward to hearing their response. The cockalicious Ezra. The The cockalicious Ezra says, “To date, Mr. Heath has produced only a threeinut video excerpt depicting redacted.” Miss Lively has consistently disputed that the video that Mr. Heath produced pursuant to the order compelling production was the video that he showed her on the set of the film. This man just happens to have another video of his wife giving birth at home. Let’s hear them out. After his council insisted for weeks that they were not aware of any other video, Mr. Heath recently revealed at his deposition that redacted yet Mr. Heath’s council has refused to produce any further video on the sole basis that in their view the order compelling production should be read exceedingly narrowly and does not require Mr. Heath to produce it. Let’s take a quick pause and look at one of the attachments to this motion for sanctions. an email from Jaime Heath and Justin Bzon’s lawyer to one of the Confederate cosplayers many many attorneys. This email was dated on Wednesday the 29th and a demand was made of the wayfairer attorney Teresa Troopson to produce the birthing video and Teresa responded saying quote counsel the court ordered the wayfairer parties to produce quote documents identified in the wayfairer party’s amended complaint including the birth video. The video described in the Wayfairer party’s amended complaint shows Heath’s wife himself and their baby after his wife gave birth at home. And their baby is both bolded and italicized, leading me to believe that the video produced was just of that. But team Vanzan wants the video of not just the parents with their newborn, but also leading up to that, the actual birth. Mhm. Terresa Troopson continues, “The video that was redacted, shown to Miss Lively, was produced more than a month and a half ago. The Wayfairer parties have fully complied with the court’s order with respect to the video. No other footage of Mr. Heath’s family is responsive to any request for production Lively has propounded and accordingly none will be produced. Before we get back to the request for sanction, I have to know why. Why are they making a mountain out of this molehill? I’m going to take a pause and come back because I really want to spend a moment thinking about it. I have no freaking idea. Even if she gets other footage of that birth, how is it going to help her? It’s not P to the O to the R to the N. I I don’t know what they stand to gain from it, but if you have any theories, I would love to hear them. You know where. All right, back to the request for sanctions. Picking up where we left off. Yet, Mr. Heath’s council has refused to produce any further video on the sole basis that in their view, the order compelling production should be read exceedingly narrowly and does not require Mr. Heath to produce it. Not so. Moreover, Mr. Heath put this video at issue by showing it to Miss Lively without her consent or any warning in the workplace. It is plainly improper for Mr. Heath to now contend that Miss Lively, this court and the jury must accept his word that the small excerpt of the redacted is the same video he showed her on set when it does not comport whatsoever with her memory and redacted by which Miss Lively could challenge his assertion once again. unnecessary redactions. Why? I know. We know why. Why? Outside of just optics, why outside of getting people speculating? There’s no need for these reductions. by knowingly and willfully withholding redacted. Miss Lively was deprived of the opportunity to fully question Mr. Heath on this topic at his deposition and has therefore been prejudiced. [Music] Accordingly, rule 37 sanctions are warranted that one, order Mr. Heath to produce all video footage depicting the birth video within 3 days of the court’s order. And two, precluding Mr. Heath from offering any evidence, including written or oral testimony on the topic of his showing the birth video or any portion thereof, to Miss Lively. This makes no sense. That makes no s. How does that make sense? If you’re going to not talk about it, okay, but if they mention it in court, they have a right to address it, right? precluding Mr. Heath from offering any evidence, including written or oral testimony on the topic of his showing the birth video. There’s more to that. There were probably witnesses who saw this exchange go down and can attest to perhaps how she responded. She didn’t seem bothered. She wasn’t freaked out as she alleged in her filings. I’m good. I’m good. Continues in the order compelling production. The court ordered the wayfairer parties to produce interalia. I have to look up that term now. Interalia means among other things. Using big words when you don’t even have to. Jesus. In the order compelling production, the court ordered the wayfairer parties to produce interalia among other things documents and communications related to Lively’s civil rights department complaint, the CRD complaint, and documents identified in the Wayfairer party’s amended complaint, including the birth video no later than September 2nd, 2025. The allegations in the CRD complaint include the following description of the birth video. Quote, “To add insult to injury, Mr. Heath approached Miss Lively and her assistant on set and started playing a video of a fully nude woman with her legs spread apart. Miss Lively thought he was showing her, you know, rhymes with corn and stopped him. So, in her filing, her CRD complaint, she admitted she barely saw it. She saw what, a second, two seconds, and stopped him. Why this fishing expedition? Then Mr. Heath explained that the video was his wife giving birth. Miss Lively was alarmed and asked Mr. Heath if his wife knew he was sharing the video, to which he replied, “She isn’t weird about this stuff.” As if Miss Lively was weird for not welcoming it. Miss Lively and her assistant excused themselves, stunned that Mr. Heath had shown them a nude video. The Wayfairer defendants now dismissed complaint, admitted that Mr. Heath showed Miss Lively a video from his child’s home birth and confirmed that he did so at Mr. Beldon’s insistence that it demonstrated Mr. Baldon’s vision for the birthing scene. But their now dismissed complaint criticized Miss Lively’s description in the CRD complaint and operative complaint of the birth video Mr. Heath showed her as an outrageous and knowingly false suggestion that she was shown corn to the ography or nicknath’s wife on set. The Wayfairer defendants pleaded that the full birth video is by all accounts beautiful. On August 22nd, 2025, the Wayfairer defendants produced a three minute 29 second video that shows redacted produced video excerpt, a snapshot of which the Wayfairer defendants included in an attachment to their publicly filed and now dismissed complaint. On September 24th, 2025, Council for Miss Lively conferred with Council for the Wayfairer defendants explaining that produced video excerpt reflected only a few minutes of footage redacted rather than redacted and does not reflect the portion of the video that Mr. Heath showed Miss Lively while she was on the set of the film. Opposing council said they had no reason to believe that the produced video excerpt was not what Mr. Heath showed Miss Lively and they were not willing to engage in further conferral absent additional information. Well, Mr. Heath sat for his deposition on October 8th, 2025. During his deposition, Mr. Heath testified that redacted redacted redacted. Mr. Heath confirmed redacted redacted redacted redacted redacted and that red. Why did you have to include and that? Just redact that. Look at look at this blah blah blah blah blah. Mr. Heath confirmed that. Redacted redacted and that this this is such a joke. There is a footnote here that specifies, “Miss Lively served discovery on Mr. Heath seeking all documents and communications concerning your allegation.” In paragraph 101 of the Wayfair SDNY complaint that Miss Lively falsely suggested that she was shown corn to theography or nicity images of Heath’s wife on set. After the Heath deposition, Miss Lively’s council sent an email regarding the Wayfair defendant’s position taken on September 24th, 2025. The Wayfairer defendants did not respond. Hm. Miss Lively’s council attempted to confer with council for the wayfairer defendants again on October 20th, 2025 to obviate the need for this motion only to be met with refusal on October 29th. There is a footnote. Upon discovering the produced video excerpt buried within Mr. Heath’s production. Miss Lively’s council immediately restricted access to only a limited group and has offered to do so for future footage productions. Blake Herd’s lawyer continues, “The court should exercise its broad discretion to sanction Mr. Heath pursuant to rule 37B2A for failing to obey the order compelling production. Specifically, the court should one order that Mr. Heath produce all video footage depicting the birth video, including but not limited to all versions that show the delivery within 3 days of the court’s order. And two, preclude Mr. heat from offering any evidence, including written or oral testimony on the topic of his showing the birth video or any portion thereof to Miss Lively. Why are they repeating themselves, babe? You already said this. There is a footnote here that says, “To the extent Mr. Heath still refuses to produce all versions of the video, Miss Lively reserves the right to seek more severe sanctions. including an order directing that certain designated facts be taken as established for purposes of this action. Our girl Ezra continues, “Preclusion is warranted, meaning not providing any evidence about showing the video. Preclusion is warranted because Mr. Heath’s refusal to produce all responsive footage has deprived Miss Lively of key evidence needed to litigate a contested issue in advance of his deposition. She’s got no evidence. We have been reminded of this time and time again. Nada. Mr. Heath’s failure to comply with the order compelling production materially limited Miss Lively’s ability to probe Mr. Heath’s recollection and testimony about the birth video at his deposition and specifically the portion of the footage he claims to have shown Miss Lively. If Mr. Heath’s non-compliance spans, he will have successfully and unfairly deprived Miss Lively from showing the jury the part of the footage she recalls Mr. Heath showing her on set. What if her recollection is faulty? Huh? She has a lot of reasons to misrepresent things. She is the mistress of misrepresentation. I don’t trust her. I don’t believe her. The court should not reward Mr. Heath for his own misconduct. Respectfully submitted, Ezra Hudson. I’m going to need to send Ezra one of my new greater than my haters shirts. Remember, they were dismissed from this saga a while back. Although a final judgment was not entered until today, the Wayfair defendants did not issue a response to the judge saying, “If you have any thoughts on the New York Times and their request for final judgment, let me know.” They did not oppose it or favor it. Team Lively was in support of the New York Times motion for final judgment and the judge just granted it. Even though it seemed unnecessary to me, they were already dismissed. But the New York Times is working to recoup and going after the Wayfairer defendants for you guys. This video made me so happy. Even though things have been quieter recently, we’ve got motion for summary judgement coming up and the trial. And I also expect some surprises between now and all of those further steps.
