No Reasonable Juror Would Believe Blake Lively?! Lawyer Reacts to Wayfarer’s Argument!
The motion for summary judgement from Justin Baldon has only left so many more questions. And luckily, we got the sexiest sounding lawyer in the world. Omar the tilted lawyer is back. Let’s do this. What’s up, Andy? Welcome to Popcorn Planet. I’m Andy. Yes. How are you, sir? Omar, welcome back to the show. I got to hear that buttery voice. Oh, I’m doing well, man. It’s good to hear from you. It’s been a while. You are the best. I love it. I love hearing you. I love having you. You make time. You always do. And I’ve been banking some content for this holiday week as I make some time with the family. And I had a couple topics I want to talk with you and I want to start with this one which is just some sort of general stuff I think we need to prepare for which is also just it starts with this emotion of summary judgment. There was one sort of quote that came in. Uh this is from Shapiro who I want to get your thoughts on generally with her as well how she’s been doing. But I want to focus on this quote. Let’s get right into it. Lively knowingly took a lead role in a provocative sexually charged film based on a book famous for its intense intimate scenes. When viewed in context, no reasonable jury could find that the handful of comments and miscommunications lively as mustard amounts to sh. What do you think of that statement? Do you agree? Do you think this is so obvious? It’s like really we’re in here cuz you got called sexy like at this point this was a a role you had to know it coming in. Uh, do you really agree that no reasonable juror is going to find these communications comments that Blake Lively is stringing together as actual sh? I guess I would take my poll from the people that have been following this case and I I’ve seen very very few if any um defending Blake Lively’s allegations as legitimate claims of sexual harassment. And so if they’re stating what she’s basically stating is let’s just assume that everything she’s saying is true. Is it a bit much like are are we seriously going to say that this is rising to the level of sexual harassment or or is there something else going on some misunderstanding or or something else going on on set? But what what she’s basically saying is if you take an objective person and you just pick them out of a jury and and they have to decide if we consider everything that lively and and we assume that it’s true, the crux of it, all of it. Is it is this sexual harassment or no? And if the answer is no, then that’s basically what she’s saying that yeah, we could lay out all of the facts. Matter of fact, they have their statement of of joint facts. There’s not really much disagreement. There’s like little quibbles here and there about the facts, but the allegations and the context around them are pretty much basically the same. And if you view them in the light most favorable to Blake Lively, can you reasonably find sexual harassment there? I personally with my understanding of what that is, cannot. And I would I have been hardressed to find any anyone that would defend the allegations as they stand in the amending complaints of Blake Lively that would agree with her propositions. Is this language though? Is it like aggressive to you or is this kind of standard for such a motion for summary judgement? Like to say something that flat out like no reasonable juror could ever. Is that typical for something like this? I don’t think it’s aggressive. I just think that it’s a it’s a it’s a factual valid legal position that they’re taking. And they kind of have to because look um she’s alleging that this these actions amount to sexual violence. She is alleging um that she invited somebody in her trailer while she’s changing out of body makeup while while while she was in a state of undress and at their invitation they may or may not have coped a look or some kind of thing might have happened and that somehow rises to the level of sexual harassment. Um they they also there’s other like tidbits in there like look there’s video evidence that demonstrabably proves some of the things that she’s saying is untrue. And so you just take it all together. Um I don’t think it’s unreasonable to say that there is not a reasonable jury out there that is going to find in favor of Blake Lively with respect to her sexual harassment allegations. If they said anything less than that, then this would not be a motion for summary judgement. It would be something else. you know, perhaps a closing argument for a jury or something else, but they have to say it that way because that’s the legal crux of their argument that look, um, she’s conjuring sexual harassment allegations out of nothing, out of minor disagreements, out of, um, you know, her personal grievances such that no objective person would agree with her. That’s a legal defense. It’s a it’s a valid legal position. And quite frankly, I agree with it. What’s also interesting to me is like as they go through this, obviously this is a high-profile case, right? It’s a high-profile case and sometimes the argument is, oh, we’re not going to be able to find someone to cover this just because of the celebrity nature of the high-profileness of it. But what’s fascinating to me as they say is this isn’t even about that. Like it doesn’t matter whether you know Blake Lively, Justin, Ryan, it doesn’t matter. It feels to me like the point is it doesn’t matter whether you know these people or not. No one’s going to sainely go here and sit here, listen to all this stuff and say this is SH. So, I mean, like it’s not really juror bias in the sort of typical sense that I think even Blake has been trying to sort of paint out there. It’s just sort of more the common sense juror bias. Is that something that that happens in like in cases like this? Like does do you think there’s a point where Blake’s lawyers are like Blake there’s not enough here to turn a jury? Like do you think that conversation is being had? Yeah, I I think they’ve been having those conversations um for a while now. And you know, whether or not, you know, her celebrities is going to impact jurors, I’m not so sure. I think that um jurors now are a lot more sophisticated on the topic of sexual harassment. I mean, we’ve gone through like the whole ringer with um you know, the Me Too movement and like you know, the pendulum swinging one way and then swinging all the way back and now I feel like we’re kind of somewhere in the middle. Um the nation at least seems to be united as to some um you know for example uh the the Epstein files they had a a recent vote 427 to1 I think that was people want to see what’s going on but I think that people are reasonable and common sense enough to be able to to to evaluate celebrity or not. Um, and I’m not honestly all that u I don’t think that that’s going to have much of an impact on the case, but I think that people are reasonable enough to evaluate her claims in the context in which they are framed, which is in a workplace environment and an environment that necessarily deals with adult content matter. And they’re going to ask questions and they’re going to want to see receipts and they’re going to they’re going to want to know what other people are saying. Is there anybody else to corroborate that people were uncomfortable on set? They’re going to hear they’re honestly I think in this case if it does go to trial they’re really going to be interested in what anybody else has to say as to the impact of the allegations that Lively has lodged against the Wayfair party specifically with regard to Justin specifically with regard to the protections that may or may not have been in place uh to some of the conduct that that was going on. But as it stands in the complaint without any corroborating evidence that I’ve been able to find, um I think that jurors are going to rely on their common sense. I don’t really feel like in this situation that her celebrity is going to sway anybody one way or the other unless you have like these fanatics, but I think that those are really quickly dismissed in Vardier, which they’re going to inevitably do if this goes to trial. So, I guess we’ll see. Yeah, it’s interesting as we’re talking about this like I the example I think of when I think of the high-profile sort of related case in a weird way is the Diddy trial, right? Which I would have thought he would have gotten more time, they would have found these things, but even he got off on a lot of those charges, the jury was a lot more forgiving in a way against that. And so it seems to me when you compare these examples that Blake’s bringing up and that that couldn’t take Diddy away, which to me they did prove it based on the law, uh they’re going to a lot have a have a lot harder of a time. I guess my question is like how strict of the is the burden of proof in a case like this and like what’s the minimum amount of evidence you think Blake needs to provide to sort of survive the judgment and reach the jury to sort of win this? Well, for MSJ, she just has to pro provide a cintillaa of evidence, you know, just the bare minimum to make this a uh an issue for a jury to decide. That’s not to say that it it doesn’t have to be a strong argument. It could be some like random declaration that somebody says, “Yeah, I agree with everything that Blake said and I was uncomfortable because of the things that were going on.” Um, that could be enough. But if she doesn’t have something to attach to it, if we’re relying on the agreed upon statement of facts that was submitted with the MSJ, um, that’s not going to be enough. So, she’s going to have to bring some kind of receipt to survive MSJ. And honestly, it’s really not that hard to do. just give me some other person that agrees with your side because it doesn’t look like there’s going to be any physical evidence. Even the video evidence that maybe she didn’t know exist um seem to discount the things that she was saying or at least prove that she’s embellished a little bit or maybe she’s being a little bit highly sensitive and honestly that’s going to greatly impact her credibility when it comes to trial. Um but she needs something. She needs a receipt. a receipt, no matter how small, to to to survive MSJ. In other words, that but that’s just the MSJ, right? Because then they got to sway the juror, the jury. And I imagine you think that’s going to be even tougher. She has to get because we’re in federal court, she’s going to have to get every single one of those jurors to believe her greater than 50% by a prepundonderance of the evidence, meaning it’s more likely than not that what Blake Lively is saying is true. And if as you’ve seen with with with juries, I think I just think that there the funny thing is I think that social media in 2025 has kind of um lifted the veil into celebrity celebrity culture and lifestyle such that we’re not really shocked by it anymore. We don’t look at these people as if they’re like these untouchable human beings. They’re humans like everybody else. And what you saw with Diddy was a jury said, “Yeah, okay. So maybe all those things happened, but what was the uh what was the involvement of all of these people claiming to be there? Did they have the ability to say no? Could they have walked away? Why did they go there voluntarily? In other words, they understood that there was a legal threshold that needed to be met and the state failed to prove that their burden and they ruled accordingly and it was probably the legally correct result. I think in this case, um, we’ve seen high-profile cases of sexual harassment, and Diddy is a great example because that was the one that had all the salacious details. So, people, if they’re going to come, uh, if they’re going to come and pay attention to this case, they’re going to sit on this jury. They’re going to be like, “Great, sexual harassment. Hit me with it. I want to see all the receipts.” And then they’re going to lay out all these things, and it’s going to be like, “Well, I invited this guy into my trailer. As I was undressing, I said he could come in and he might have peaked a look.” What is that? Okay. So, what else do you have? Well, these other things and they’re just going to go down the list and they’re going to have to either agree or or disagree or I’m sure they’re going to have questions. And I’m just don’t think that given the low level of evidence that I’ve seen now in almost a year of litigation that she’s going to be able to meet even this low burden of prepundonderance of the evidence with respect to the sexual harassment claims. So, she’s in a lot of trouble if this goes forward. Well, and add to the fact that she ended up getting the power from this relationship, not the other way around. She was using all that to her advantage. And then the Vanzam lawsuit and all the other evidence, which I want to keep you for another one to talk about. So guys, make sure you stay tuned. I only see defenders of BL on FB and it's SUPER weird, because they are INCESSANT in the comments, over and over, then vanish like a thief in the night after the one post they went weird on.
Remember all those organizations that wrote Amicus Briefs for Lively earlier this year? Time called her a Titan Influencer… These organizations are now quiet about Lively. I wonder if Time knew then what they know now – would they still have named her as a Titan Influencer?
I think it was your guest last week, and I agree, Reynolds is only A-list because of Deadpool. Deadpool made a lot of money, but he's not known for anything else, acting wise that is.
For example, Scarlett Johansson has "Lost In Translation," "Her," and she's funny on SNL and she's done Broadway.
Being uncomfortable with someone is not SH unless it becomes of an unwelcome sexual nature which this clearly wasn’t. Also her comfort level appears to be at her whim as it pertains to the case. She certainly had no discomfort with him when this movie started filming but all of a sudden was uncomfortable when she decided to take it over and he wasn’t willingly bowing down to her demands. I don’t think she has one iota of guilt or shame for the repercussions this case will have on future legitimate SH claims being taken seriously.
