Plaintiff Blake Lively moves for an order confirming that her requests for admission are deemed admitted due to the Wayfairer party’s failure to provide timely responses. I just want to skip to the part where the judge rules He says the wayfairer party’s objections to the requests for admissions are without merit. The wayfairer parties object to the number of documents Lively asks to be authenticated. However, the volume of documents is reasonable given the number of parties and claims. Okay. The court has the power to permit what would otherwise be an untimely answer even after the time fixed by the rule has expired. A short extension would aid in the presentation of the merits of the case and would not prejudice lively. Accordingly, by December 5th, 2025, that’s later this week. What is that? Thursday, Friday, Friday. By Friday, the wayfairer parties shall answer the request for admissions as corrected on October 31st, indicating for each wayfairer party whether the party admits or denies the authenticity of the identified. Yay! A loss for Blake Lively. Woo! Woo! The whole request for admissions thing is so boring to me. It’s just paperwork. Translation, if you weren’t following any of that, they’re literally bicking bickering over paperwork. Not just paperwork, but you know, in some instances here, also um video or in the Claire Aub of it all, secretly recorded audio. So both sides have submitted evidence, you know, documents, emails, texts, information that needs to be authenticated and they have to agree on this. Yes, that’s real. No, we don’t. We we can’t verify this. So Blake Lively was trying to get a win and she got a loss. Yay. Every little loss for her will sure be welcome indeed, Hely. And I just want to check in with my members. I’m not even going to say easier because this is not easy. It’s more manageable to do it as a live stream than a video. Doing it the normal way. It would literally take me three times as long. I’ve not seen this before, so this is new to me. Okay, this is in regards to that timeline that we went over last week. Remember the timeline where the big news that’s been getting a lot of attention was that Taylor Swift and Hugh Jackman were at that meeting in April of 2023 and Justin Belon cried and this was during pre-production. That still boggles my mind. Ryan Reynolds went and they hadn’t even begun filming all over the trainer question about how much weight Blake Lively weighs. Hey, Empathy. Hey, Rex. So, why did you ask Miss Tosco to create a timeline on June 17th? Says Ezra Baldon’s producing partner Jamie Heath. Just to have a timeline of our whole experience of the movie. Ezra, your whole experience of the movie as it relates to Miss Lively. Jaime Heath, just our the timeline of what we experienced throughout the movie. Yes. Ethically challenged Ezra. For what purpose? Jamie Heath. So we could have a record of our the last year and a half of what we have experienced. Ezra, why Jamie Heath? There was a lot that went on over the year and a half on different levels, production and all levels. I just wanted to have a timeline of it. Ezra, well, your your text message to objection says Alex Shapiro. I don’t know, says Jamie Heath. Ezra, okay. Well, why are my question to you, Mr. Heath, is why you were asking Miss Tusco to create a timeline that references events related to Miss Lively on June 17th, 2024. Jamie Heath, our experience of the movie. And at this point in June, we were unsure. Justin had lost the movie. I think by this point, we were dealing with a lot of conversations with Sony about how to navigate moving forward with him as the director. We’ve got the release of the movie coming up. And in all of this and being confused of where we stood with all of this, I just wanted to have documented just our our whole experience with the movie. Ezra, for what purpose, Ezra? Heath just so I could have a good recollection of it so that I knew what our last year and a half was. Blake Lively’s cash cow. Were you looking for a timeline of incidents related to Miss Lively’s complaints? Objection, says Alex Shapiro. Jamie Heath. No, not necessarily. We just I just wanted any experience that we had in all capacities to be have a timeline, Ezra. Well, but the timeline doesn’t address every experience that you had in all capacities, does it? This woman gets on my last nerve. Jamie Heath, I haven’t gone through the whole thing, but in all capacities, just with our experiences certainly with I mean I can see that you know a lot of this is with Blake. So that was a big part of our experience Ezra that was a big part of your experience and incidents where Miss Blake or Miss Lively expressed concerns. Correct. Objection says Alex Shapiro Jamie Heath I would say it’s exactly what I said it was. Ezra and the incidents that you identified to Miss Tuskavic are incidents that you were aware that Miss Lively had raised concerns of prior to June 17th, 2024. Correct. Can you repeat that please? Yes. that these were all things that Miss Lively had raised concerns about. Correct? Says Ezra. Objection, says Alex. Jamie. Some of them, some of them not. Okay, asks ethically challenged. Which one of these lists are not things that Miss Lively had raised concerns about that you were aware of on June 17th? Objection, says Alex Shapiro. Jamie Heath. Well, just as I go through it, when we shot the graveyard scene, when we had a meeting at Blake’s house, good answers. Blake was not complaining about the meeting at her house. Wayf Farer was. Ezra, why did you want to have a record of when you had the meeting at Blake’s house? Jamie. It was one of the things that we’d experienced on the movie. Uhhuh. Says Ezra. And when you said essentially anything we can get either the date and alleged incident, what did you mean by alleged incident? I don’t recall, says Jamie Heath. I don’t know. Are are you you don’t know what you meant by alleged incident? Says Ezra. I don’t know exactly. Okay, says Ezra. And did you have any further followup with Miss Tusc meant by alleged incident? I don’t know. You don’t know if you did. I don’t know, says Jamie Heath Ezra. But somehow from did you give her any direction beyond what you put in this exhibit 16? I don’t know, says Jamie Heath. Exactly, Nancy. This is Ezra’s tactic and it’s not working. Jaime is not breaking. Depositions are like war, y’all. Trial is war. You have to have strength. Okay. Had you talked to Miss Tosco about the alleged incidents before? Objection, says Alex Shapiro. I don’t recall, says Jamie Heath. Ezra, did you assume she understood what you meant by that? No, Mary. Meil Gerniski was the lead attorney in Vegas when I had to show up in court twice. Let’s um take it back. Did you assume she understood what you meant by that? Yes. I think at that point it was a quick Oh, sorry. We skipped pages. So, we’re still talking about the timeline of events. Jamie Heath. I think at that point it was a quick way to give them I’m assuming he’s talking about Sony a glimpse of a timeline of our experience. Your experience with Miss Lively says Ezra. Our experience that was outlined in this timeline says Jamie. Your experience with Miss Lively? Ezra asks again. That is part of it, says Jamie. Okay. Ezra says it was a way to give tag. Okay. We’re talking about the agency group. A quick update or a summary of the alleged incidents as you described them. Correct. Objection, says Alex Shapiro. Jamie Heath. I wouldn’t characterize it as that. I just think it was a quick way to get a little bit of an update of some of the elements, Ezra. Some of the elements of issues that had arisen with Miss Lively, correct? She keeps asking the same thing over and over again, just in different ways. What Bazia said, Jamie Heath. So he responds to Ezra saying some of the elements of issues that had arisen with Miss Lively, correct Jamie? of our experience of the set and some of that included experiences with Miss Lively for sure Ezra and that’s because you had retained tag at that point to help you with crisis management related to your concerns about Miss Lively potentially going public. Correct. H we skip pages. So, picking up somewhere else later in Jamie Heath’s deposition. Yes, that makes sense. Lawyer Liz, she deleted Lawyer Liz deleted her comments. But I’m guessing Ezra is trying to infer that at least as of June 2024, Wayfair had an obligation to preserve all communications because they she’s trying to infer that they were aware that of of a potential lawsuit. But I would disagree, especially because Bel Blake Lively did not send her notice of preservation until December of 2024. December. So, and Jamie Heath very smartly was responding, “No, we were just focused on PR. We were not thinking I mean I don’t want to put words in his mouth but thus far from everything Jamie Heath was saying they just wanted to capture all of the experiences so that they could have tag the agency group help them. Okay. All right. Let’s continue. Um picking up somewhere later in the deposition. Other than him saying things like, “Things are looking okay out there. So sorry for what’s going on.” He would give some general acknowledgements of that nature, but we didn’t get into the weeds. Ezra, he didn’t tell you what it was he saw. Have no idea what they’re talking about here. Jamie Heath, I don’t recall exactly what was said, but we did not get into weeds of stuff. Ezra, so your testimony is that in the conversations that you had with Mr. Wallace, Jed Wallace, they were just check-ins essentially about your well-being. Objection, says Alex Shapiro. Jamie Heath. I mean, I’m looking at our text threads here. I appreciate this message. Jamie Heath reads, “Congrats on a big weekend. appreciate you. Looking forward to meeting you. Just checking in. That was typically, you know, we connected. Ezra Hudson, you didn’t have conversations about the work, though. Is that what you’re saying? That you had contracted with Mr. Wallace to do for nearly $100,000? Objection, says Alex Shapiro. And then also I believe uh a lawyer for Jed Wallace objects as well. Jamie Heath, it would be like me having a conversation with somebody about a world in a language I just don’t understand. That wasn’t our conversation. It was just more we connected and that was what our conversations were. Ezra Hudson, I’m trying to understand why you feel the world that Mr. Wallace occupied was something that you couldn’t understand. Why is that? Objection, says Alex Shapiro. Jamie Heath, I am not a digital monitoring person that understands social media and all of that. So Ezra, why did you understand did what did you I just burped. What did you understand digital monitoring to mean? Jamie Heath monitoring what was going on in the digital realm? Ezra, and you weren’t curious about how Mr. Wallace did that? Jamie, it wasn’t one of my I didn’t have any reason to be concerned about it or think about it beyond that. It just was he was here to help and that’s all that that’s all that mattered. He was doing it in a way that I understood was aligned with us. Ezra, so you may have communicated with other people on Signal in August of 2024 other than the ones you identify. Jamie Heath, I don’t have a particular recollection of it because I think that was the only people that I communicated with at that time, but I don’t know. Ezra, did you communicate with Mr. Freriedman on Signal in August of 2024. If you’re watching, you probably know that Freriedman is in reference to Brian Freriedman, the lead attorney for the Wayf Farer parties, who in August of 2024 had not been retained yet. If I remember correctly, I think they did not officially retain Brian Freriedman until sometime in December. right early December, I think. But they probably were talking to him a lot before then. Um, I don’t know about communicating with Brian Freriedman in in uh August of 2024 on Signal. You may have, says Ezra. I don’t know, says Jamie Heath. Um, Belon says, and this is the very first page, has invested, to my knowledge, over $100 million, and that’s nowhere near the amount of profit we made on It Ends With Us. Isn’t that wild? Cuz it Ends With Us was a hit movie, especially compared to the budget. like it was a med a mid-budget film and it ended up making a lot of money at the box office. Is there documentation that would show the payments that you have received, if any, derived from the film? It ends with us. Of course, says Belon. Have you produced those to us? Belon, my lawyers have everything that would need to be produced. So, I would assume that if that was something that would need to be produced that they would produce it. Lively’s lawyer, do you recall telling us in an interrogatory response that you first anticipated litigation about it ends with us in August of 2024? I don’t remember, but I’m assuming that’s correct. Lively’s lawyer, did you understand after that point in time that you were required to preserve all documents concerning the litigation that you anticipated? No, says Belon. When did you understand that? I believe this last week, says Belon. His deposition happened last month. I don’t believe him. He had to have he had to have known this prior to last month because you know what’s interesting? Beloni sat in on a lot of the depositions by Zoom of some of the other parties. I think I remember reading or seeing last week that he was appearing by Zoom in somebody else’s deposition. He’s lying. He’s lying, right? I’m team truth. You can be team truth and be like, “Justin’s probably lying there. He’s not that checked out. He’s been very involved in all of this. Okay. This last week is the first time you understood that you were required to preserve documents in this case, says Lively’s lawyer. Baldoni. Yes, but I preserve them anyways. Lively’s attorney. What steps did you take to preserve your documents, if any, in August of 2024? By not deleting anything, says Baldoni. Okay, so you didn’t delete anything. Did you have any understanding of the retention policies that existed on your email account? Can you be more specific? Asked Belon. Do you have any knowledge as you sit here today, one way or the other, whether the email accounts that you use have retention policies on them? The fu I don’t know how to What kind of a question is that? Are there email accounts that automatically delete emails? Does that exist? I know that Signal and things like that can sometimes automatically delete communications, but are there preferences that automatically delete emails from email accounts? Mike Gotautly was the one asking the questions. Okay. All right. God, we still have more to get to. Holy heck. This was hilarious. This was hilarious. Okay. in their answers to Blake Lively where uh interrogatory number 18. Identify all individuals or entities other than you whom you contend directly and approximately caused Miss Lively’s damages and injuries as stated in paragraphs 483 and 484 of your answer. Wayfairer said, “Responding party objects that this interrogatory seeks information subject to expert opinion and presumes that Lively has incurred damages and injuries which responding party denies without waving these objections.” This is the list of people that Wayfairer says is responsible for Blake Lively’s damages. They say Blake Lively, Ryan Reynolds, Maximum Effort, Blake and Ryan’s marketing company, Leslie Sloan, Blake’s publicist, Vision PR, Leslie Sloan’s PR company, Stephanie Jones, Jones Works, and Sony. Delicious. Delicious. All right, I’m not gonna I’m not gonna read. There’s just so much you guys. I’m going to read summaries now of things just so that we’re fully caught up. All right. Also, recently unsealed more of Jen Abel’s deposition. Um, Mike got They’re discussing the requests, the 17 protections, blah blah blah blah blah. More of Steve Sarowitz’s deposition. Jed Wallace’s declaration says, “I do not have a digital army in Los Angeles, in New York, or anywhere else. I do not work with or direct a team in Hawaii. Uh, Jen Ael argues that all negative public criticism of Blake Lively was entirely organic. She cites paparazzi photos, Lively’s marketing missteps, her refusal to appear with Baldoni, mass cast unfollowings, tone death product tie-ins, and her New York Times involvement as reasons public sentiment turned against her. Abel says Lively fueled negativity by allegedly feeding the New York Times with stolen private communications and using inflammatory texts prior to filing her lawsuit. Abel asserts that the positive surge of support for Baldoni was also organic, driven by his consistent serious engagement with the film’s dev themes and his partnership with the nonprofit No More. Contrasted with Lively’s handling of promotion, she claims Lively acted with unclean hands by orchestrating hostility on set, excluding Baldoni from promotional events. Hey, Godman. Disrespecting his religious beliefs and downplaying the film’s DV themes while cross-promoting her alcohol and hair brands. Abel claims that Lively failed to mitigate damages, arguing that she caused any reputational harm herself through PR choices, false statements, her Vanzan lawsuit, and what Abel calls abusive legal tactics against content creators. Abel accuses Lively of running a coordinated smear campaign against Baldoni and Wayfairer, including orchestrating cast unfollows, excluding Belon from press and photos, removing his name for marketing, planting negative stories, coordinating a hit piece with the New York Times, releasing her CRD complaint for maximum reputational harm, using Darbo accusations tactically. Wow, that was good. Woo! Child. Oh, I think there’s no way Blake Lively is going to win any of this. That was Jen Abel, Belon’s publicist, 1983, not Nancy. All right, shout out again to Totally Texas for more recap. Um Baldon’s deposition. He testifies he did not have personal involvement in selecting Melissa Nathan. I think we’ve seen some of this before. Yeah, we’ve seen some of this. Jamie Heath Oh, this is good. I don’t remember reading some of these. Jamie Heath explains that once he instructed Stephanie Jones to stand down and not contact reporters, he did not bring her back into any communications or publicity strategy for Wayfairer. He clarifies that from his perspective, Stephanie Jones was never part of Wayfairer’s crisis communications team to begin with. So there was no removal or reinstatement. A little bit of Jed Wallace’s deposition. I don’t think I’ve seen any of or much of this. Wallace says he does not recall ever being copied on communications with Stephanie Jones regarding Wayfairer related work. Wallace says he does not recall ever speaking with Stephanie Jones in connection with his work for Wayfairer. Insane. Holy hell. So much was unsealed. Okay, that’s everything, y’all. I think you’re not dying you just peaked a bit due to the whole Lively thing ,that’s actually what got me watching more, and now that trial is waning, it happened to a lot of channels
I gotta tell ya for your ratings going down you still do way better than quite a few big time live streamers on here. Ive compared forsay you posted a video 9 hrs ago and got 17.000 views ill go to someone else that does what you do (less enthusiasticly of course 😁) and look at a video with a similar time frame and more often than not you have more views. I do it out curiosity cause im like Perez is the best and well known for a long time what could be going on.
