Marius Borg Høiby has been denied home detention while awaiting his verdict/possible sentencing. This request has been denied twice. He and his defense team are now appealing to the Norwegian Supreme Court.

René Ibsen, his lawyer, wrote that "[they] believe that the Court of Appeal's ruling is not fully justified, and [they] therefore request that the ruling be overturned."

Previous denials have alleged that Høiby has a significant risk of recurrence. A legal counsel representative for one of the survivors agreed with the initial court ruling, also pointing out the high risk of recurrence.

Høiby has been charged with 40 counts, including rape, abuse, and domestic violence.

A verdict is expected on June 15.
