
Mangione's lawyers informed Judge Gregory Carro that they will attempt to show that he was suffering from “extreme emotional disturbance at the time of the occurrence.”
If they succeed, Mangione could be sent to a psychiatric treatment facility instead of prison.
The information came two weeks after Carro held a secret hearing on the matter at the request of the defense. He said he will unseal records pertaining to the hearing and the defense's move for a psychiatric defense.
The judge had been set to rule on the matter on Tuesday, but delayed it a day because prosecutors failed to inform Mangione's jail that the defendant was needed in court.

Oof, bad move. Obviously we only see a very small small amount of what is going on behind closed doors, but it’s seemed like he’s been making a life for himself in prison. Going to a prison psychiatric facility would probably be a significantly worse outcome for him, those places are not known to be kind, even by prison standards
Psychiatrists/facility that the heath care company in question probably would have/does deny coverage for and absolutely not see as a medical necessity.

I can see it. I get my morning soda on the way to work and there’s a woman in her 70’s and she lives in her car. Sweetest woman, doesn’t bother a soul. I buy her breakfast and she has a cat in the car so I buy her cat food too. The injustice and cruelty in daily American society is enough to drive anyone with a conscience and a heart insane.

I’m still hoping for jury nullification. I am interested to see the evidence from this trial because what was released before they found him & when he was arrested didn’t seem that convincing? I swear they showed us surveillance footage of at least five different guys for instance.

So they’re admitting that he did it? I was wondering if they ever released evidence to the public showing it was indeed him. A psych hospital may be more gentle in certain ways, but I don’t know if one would want insurance companies handling their living conditions. Not to mention a stricter day to day routine that doesn’t have as many opportunities for smuggling contraband.
I still don’t think the evidence is that strong for him being the person who did it.

Oof I dont know about this. I once read about this bloke who faked insanity to avoid prison. Thing is because he couldn’t prove that he was sane, he ended spending more years at the Psychiatric facility than he would have in prison.

Yall a psychiatric defense is different than pleading insanity. He’s essentially admitting to the crime with the caveat that his judgement was momentarily clouded by several factors. He won’t be sent to a psych hospital, he’ll still get prison time. I’m pretty sure the play is to get the charge from murder to manslaughter

Psych facilities are frequently as bad as or worse than prison, but at least it’s not the death penalty

Everyone saying there wasn’t enough evidence…clearly his team and him are spooked enough to go with this defense. This defense seems poor on numerous levels. For one, aren’t psychiatric defenses notoriously difficult to push forward? And two, doesn’t this take away the political/ethical/whatever power of his actions by essentially saying he wasn’t in his “right mind?” The unabomber (not a comparable set of actions, but another intelligent man who said his actions were related to his political and ethical beliefs) refused such a plea because he worried it would discredit him.

I, too, find myself mentally unwell thinking about how insurance gets to dictate medical care without formal medical training – thus leaving many individuals who need care, without it.
