Shawn Diddy Combmes still has months until his fates handed down in the wake of his convictions. After the media mogul’s legal team had first proposed rushing his court date, a request they later retracted, the judge overseeing his trial revealed on July 8th, Diddy’s day in court coming October 3rd. The original date set after a jury found him guilty of transportation to engage in prostitution charges while acquitting his counts surrounding sex trafficking and racketeering. E-News has reached out to Diddy’s legal team for comment but has not yet heard back. Per NBC News, Diddy’s convictions could earn up to 20 years in prison. His attorneys seeking a roughly two-year sentence with the request from prosecutors surrounding four to five years. When Diddy appears in court October 3rd, he’ll have spent more than a year behind bars. Following his arrest in September 2024, NBC News confirmed that time in federal custody, counting as credit for time served toward his eventual sentencing. With his bond denied, Diddy will remain in prison until the court date a month shy of his 56th birthday. [Music]

He’ll get 6 months tops
First Diddy was arrested on Sept 16 2024 if he gets 2 years on Oct 3 will count as a year he would come home and be released on Oct 3 because they cut your time down to half under good behavior and he probably gets 11 months probation but only if he gets the 24 months I don't see him getting any longer than that Now at least he can come out and be who he is freely without hiding it.
I wouldn't be surprised if the court let's him free.

We’ve recieve a few inquiries as to whether the federal judge in the Diddy case can use acquitted conduct to enhance his sentencing exposure.
The short answer is yes. He was indicted by the feds on September 12, 2024 for criminal conduct preceding that date. The feds use what’s called the One Book rule which means that they use the guidelines and statutes in effect at the time the crimes were committed.
If his criminal conduct was charged after November 1, 2024, the federal courts are generally prohibited from using conduct for which a defendant was acquitted in federal court to enhance their sentence under the federal sentencing guidelines.
The United States Sentencing Commission (USSC) amended the guidelines to prevent judges from considering acquitted conduct when calculating a defendant's sentence range. This change aims to uphold the principle that "not guilty means not guilty" and to ensure greater fairness and public confidence in the justice system.
Elaboration:
Prior to this change, federal judges could consider acquitted conduct when determining a sentence, even if a jury had found the defendant not guilty of that specific conduct. This was often based on the lower standard of proof required at sentencing (preponderance of the evidence) compared to the standard at trial (beyond a reasonable doubt).
The USSC's Amendment 826 specifically revised the relevant conduct guidelines to exclude acquitted conduct, meaning judges can no longer use it to increase a defendant's sentence range under the guidelines.
Important Exception:
While the amendment generally prohibits the use of acquitted conduct in calculating the sentencing guidelines range, it's important to note an exception.
If the acquitted conduct "also establishes, in whole or in part, the instant offense of conviction," it can still be considered.
This means that if the acquitted conduct is intrinsically linked to the crime the defendant was convicted of, it might still be relevant for sentencing purposes.
Overall Impact:
This change is expected to lead to more consistency and fairness in federal sentencing, as it ensures that a defendant's sentence is not significantly impacted by conduct that a jury has already found them not guilty of.
However, federal judges can still consider a defendant's overall background, character, and conduct when determining the appropriate sentence under 18 U.S.C. § 3661, which allows for consideration of a wide range of information.
