Gottlieb says that the Court "held" Ms Lively provided sufficient evidence and the wording in point 3 is interesting "Baldoni … understood that her claims amounted to sexual harassment … " – adding the word "allegations" seems to have been an afterthought. None of her claims satisfied the elements of sexual harassment to "amount". The judge didn't need to go through the elements – she failed on being an independent contractor and also where it was applicable to an independent contractor, that failed because the alleged conduct occurred in New Jersey – not California. That was based on applying the facts to the law – not a technicality like filing out of time. You are right in saying that Gottlieb should have known she was an independent contractor but pushed it as her being an employee. On his firm's website, he doesn't list the Lively as one of his "selected significant matters" even though this case eclipses his other cases in public attention and cost
