Daily Mail branded Prince Harry and the group of celebrity plaintiffs’ claims as “lurid” and “simply preposterous.”
While the lawsuit is going to trial, the allegations of “burglary to order” won’t. “Even if proved true, they cannot assist in the fair resolution of the claimants’ claims. It is not alleged that this incident has any connection with any claimant, or any pleaded journalist,” Justice Nicklin said in his ruling.

“The events took place over 30 years ago. This is not a small area of the case. It is now a substantial dispute of fact,” Justice Nicklin continued.

Prince Harry, Elizabeth Hurley and several other British A-listers accused the Daily Mail and its publishers of unethical practices. However, the judge wasn’t confident in their ability to prove their claims of illegally accessing their property.
“The costs and resources that would be devoted to resolving the factual dispute would, I am satisfied, be out of all proportion to any possible evidential value,” Justice Nicklin said. “Put bluntly, it has become a complex and involved side-show.”

Justice Nicklin said it wouldn’t be helpful to decide if the Daily Mail’s alleged illegal information gathering was “widely and habitually carried out.”
